Required Documents for Foreigners
When applying for marriage, the foreign partner must present the following documents for inspection. The foreigner must present: a passport or national identity card, and a residence card, if one has been issued.
Birth certificate
A copy of the birth certificate must be submitted together with a Polish translation prepared by a sworn translator registered in Poland, a sworn translator authorised in an EU or European Economic Area (EEA) country, or a consul.
Documents Concerning a Previous Marriage
If the foreigner was previously married, they must present documents confirming that the earlier marriage has ended.
This may include:
- a marriage certificate with a note confirming divorce,
- a marriage certificate confirming annulment,
- a marriage certificate confirming that the marriage legally no longer exists, or
- a marriage certificate together with a document confirming divorce or annulment if the necessary information cannot be determined from the other documents.
These documents allow the Civil Registry Office to confirm that there are no legal obstacles to entering a new marriage.
Certificate of Legal Capacity to Marry
A foreigner must also provide a certificate confirming that, under the law of their home country, they are legally allowed to marry.
This certificate must be translated into Polish by: a sworn translator registered in Poland, a sworn translator authorised in an EU or EEA country, or a consul.
When the Certificate Cannot be Obtained
In some countries such certificates are not issued. In such cases the foreigner must apply to a Polish district court (Sąd Rejonowy) for a decision exempting them from the obligation to submit this document.
Declaration of no Legal Impediments
When submitting the documents, the couple must sign a declaration confirming that there are no legal obstacles to the marriage.
If the foreign partner does not speak Polish fluently, the presence of a sworn interpreter is required: during the submission of documents, and during the wedding ceremony itself. The couple must arrange the interpreter on their own.

Practical Advice for Foreigners
Preparing the required documents in advance can significantly speed up the procedure. In particular, foreigners should verify whether their home country issues a certificate of legal capacity to marry because obtaining this document may take additional time.
If such a certificate cannot be issued, it is necessary to apply to a Polish district court for an exemption before the marriage procedure can continue.
